These Terms and Conditions ("Terms") govern your access to and use of tenavet.com (the "Site"), which is the marketing website for Record Health. The Site is operated by Tenavet LLC ("Tenavet," "we," "us," or "our"), a limited liability company organized under the laws of the State of California, United States. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Scope of These Terms
These Terms apply to the Site only. The Record Health iOS application is a separate product and is governed by its own End User License Agreement, Privacy Policy, and (where applicable) Business Associate Agreement, which you will be presented with before installing or using the application. In the event of any conflict between these Terms and a separately executed agreement, the separately executed agreement controls.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Site. By using the Site, you represent that you meet these requirements.
3. Use of the Site
You agree to use the Site only for lawful purposes. In particular, you agree not to:
- Access the Site by automated means in a manner that places an unreasonable load on our infrastructure;
- Interfere with, disrupt, or attempt to gain unauthorized access to any portion of the Site or its underlying systems;
- Reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the Site without our prior written permission;
- Use the Site to transmit malicious code, harvest personal information, or send unsolicited communications;
- Use the Site in any manner that violates applicable law or infringes the rights of any third party.
4. Intellectual Property
All content on the Site — including text, graphics, logos, images, video, software, and the overall look and feel — is owned by Tenavet LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
"Tenavet," "Record Health," and their associated logos are trademarks of Tenavet LLC. You may not use these marks without our prior written permission. You may view, download, and print pages from the Site for your own personal, non-commercial use, provided you do not remove any copyright, trademark, or other proprietary notices.
5. Submissions and Communications
If you send us inquiries, feedback, ideas, or other communications through the Site (including by email), you agree that we may use them without restriction or compensation. Do not send us Protected Health Information (PHI), confidential medical records, or other sensitive personal information through the Site unless we have agreed in writing to receive such information under specific terms.
6. Third-Party Links and Services
The Site may contain links to third-party websites or services that are not owned or controlled by Tenavet. We are not responsible for the content, privacy practices, or terms of any third-party site. Your interactions with any third-party site are solely between you and that third party.
7. About Record Health
References on the Site to Record Health describe a product in development. Features, availability, timelines, and pricing may change before launch. Nothing on the Site constitutes a binding commitment to deliver any specific feature or to release the product on any particular schedule.
8. Not Medical Advice
Nothing on the Site, and nothing produced by Record Health, constitutes medical, legal, financial, or other professional advice. Record Health is designed to help you organize and review your own medical records; it is not a substitute for the judgment of a qualified healthcare provider. Always consult a licensed professional for medical decisions.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Tenavet disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
10. Limitation of Liability
To the maximum extent permitted by law, Tenavet, its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Site, even if Tenavet has been advised of the possibility of such damages.
In no event will Tenavet's total aggregate liability arising out of or relating to these Terms or the Site exceed one hundred US dollars (US$100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Tenavet and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your access to or use of the Site or your violation of these Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective" date above. Material changes will be reflected on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
